EFFECT OF LAND OWNERSHIP DISPUTES ON REAL ESTATE DEVELOPMENT IN SYOKIMAU, KENYA: A META-ANALYTIC REVIEW OF EMPIRICAL EVIDENCE
Abstract
Purpose of the study: This paper synthesizes empirical evidence on how land ownership disputes affect real estate development in Kenya, using the 2011 Syokimau demolitions as an illustrative empirical case.
Problem statement: Kenya's real estate sector has expanded rapidly along Nairobi's urban corridors, yet unresolved land tenure conflicts continue to trigger demolitions, stalled projects, and investor losses. Despite the 2010 Constitution and the land statutes of 2012, the literature on how disputes translate into development outcomes remains scattered across disciplines and has not been systematically synthesized for the Kenyan context.
Method/methodology: The study adopts a systematic narrative review, informed by the PRISMA 2020 reporting standards, synthesizing peer-reviewed and institutional literature on land disputes and property development in Kenya and comparable developing-country settings, complemented by a documentary case analysis of the Syokimau demolitions.
Results of the study: The synthesis shows that fraudulent and double allocation of titles, weak boundary enforcement, and slow adjudication are the dominant drivers of disputes affecting real estate, these disputes depress investor confidence, disrupt access to credit, delay project completion, and, in the Syokimau case, resulted in the demolition of roughly 600 homes and the denial of compensation to affected owners.
Conclusion and policy recommendation: Land ownership disputes exert a material and largely negative effect on real estate development in Kenya. The paper recommends accelerated digitization of land records, mandatory pre-development title verification, dispute fast-tracking through the Environment and Land Court, and statutory buyer-protection and compensation mechanisms.
